Repair Terms of Service

The Appliance Shark, LLC — General Terms and Conditions of Service

If you contract with The Appliance Shark, LLC to do work for you (the “Customer”), the following terms and conditions (“General Terms and Conditions of Service”) will apply to the services we perform and the spare parts or other goods we provide. It is your responsibility to familiarize yourself with these terms prior to allowing our technician to commence work. By visiting our website, scheduling a Service Call, confirming an appointment, approving a repair, or allowing our technician to commence service, you accept all terms and conditions detailed herein.

Payment and Conditions of Service Provision

It is the responsibility of the customer to familiarize themselves with terms of service at time of scheduling and prior to allowing our technician to commence service. Scheduling of service with us implies full acceptance of our terms and conditions as detailed, as does allowing our technician to commence service. Acting either for yourself or for the party listed on electronic or paper work order you agree to pay all the following where applicable: any unpaid balance upon completion, 24% APR interest and service charges on any past due balance, a $30 service fee if your check or credit card is not honored by the bank, necessary handling and return charges if your work order is canceled in an untimely fashion, and any necessary collection costs, including attorney's fees. Payment is due on provision of service unless terms have been agreed or other previous arrangements have been made.

Cancellation of Service

We reserve the right to charge an amount equal to 100% of the service call amount for any appointment missed, canceled, or changed without 24 hours’ notice (or otherwise mutually agreed). You also agree to pay shipping/handling costs and any non-returnable parts associated with a customer-approved repair.

Service Call

For the Service Call (“Diagnostic”/“Inspection”), the appliance must be installed and accessible. The Service Call fee covers travel, initial inspection, diagnosis, and a written estimate. It does not cover any repair and is not refundable. Repair and Sealed System Service Call charges are separate. Technicians cannot change previously agreed charges (they may add charges if additional services are requested/required). If access is not provided, additional access fees may apply.

If the technician cannot duplicate the complaint, or if no problem is present (“No problem found” / “Operating properly”), the Service Call fee still applies. Intermittent problems may not be diagnosable unless present at the time of service. If an outside trade contractor is recommended, you are responsible for their costs; our Service Call fee still applies.

Due to appliance complexity, underlying issues may not appear until an initial repair is made. If so, we will provide a free additional diagnosis and revised estimate. Exception: sealed system failures require a separate Sealed System inspection.

Sealed System Service Call

Separate from a standard Service Call and nonrefundable. This is an in-depth inspection/diagnosis of sealed system components (compressor, condenser, evaporator, filter drier, valves, copper/aluminum tubing, refrigerant). Due to complexity, some failures may not be readily apparent or repairable (e.g., micro leaks, blockages, leaks in non-repairable areas, or obsolete refrigerants). Success is not guaranteed; you release The Appliance Shark, LLC from liability arising from Sealed System service/repair.

Multiple Appliances

We may apply a discounted Service Call fee for additional appliances at the same visit. Otherwise, all standard Service Call terms apply. Technicians cannot inspect or “just look at” any appliance not documented and charged an appropriate Service Call fee.

Repair

Repair charges are separate from Service Call fees and are based on The Original Blue Book Major Appliance Job Rate Guide®, not hourly time. Pricing reflects complexity, difficulty, risk, tools, training, and supplies. Technicians cannot change previously agreed charges (they may add charges for requested/required additional services). Additional access fees may apply if the unit is not readily accessible.

Standard Appliance Installation

Covers removal/installation without disassembling or altering appliances, cabinetry, countertops, flooring, doors, or other fixtures. Assumes easy access and no special handling/extra technicians. Additional services may incur additional charges or be declined at our discretion.

Does not include modification/repair of gas/water valves, drains, power receptacles, electrical junction boxes, or dryer vents. Customer must ensure supply, electrical, drainage, and ventilation systems are present, code-compliant, and suitable. We do not verify ventilation/electrical/water/drainage requirements; customer is responsible for compliance and readiness.

Warranty

Service Call and Repair warranty for additional appliance issues or manufacturer part failure is 90 days. Void if third-party work/inspections occur, damage is caused by others, or if the diagnosed repair is declined. No warranty against additional/more extensive repairs or other problems on the same machine.

Parts carry the manufacturer’s warranty (usually 30–90 days). Customer pays shipping/handling/processing to honor valid parts warranties. Timing depends on manufacturer availability. If a manufacturer will not honor its warranty, customer is responsible for the part cost. Shipping/handling are non-refundable. Electrical or special-order parts are not returnable. Repair charges (excluding warranty parts) apply outside the coverage window or when voided.

Intermittent Condition

No labor warranty for intermittent problems; they cannot be traced unless present at time of service.

Limitation of Liability

If inspections/repairs cannot be performed, are delayed, or are unsuccessful, liability (including consequential damages) is limited to the amount actually paid by the customer.

Damage Waivers

Waiver: Inspecting or Repairing Defective Appliances

Risks include damage to the machine, failed or surrounding parts (e.g., rust, corrosion, stripped screws). Seized/failing parts may fail upon disassembly/testing. You agree to hold harmless the technician and The Appliance Shark, LLC for such damages.

Waiver: Moving Appliance

Movement may damage the appliance or surrounding areas (flooring, cabinetry, countertops). Movement is not required; if performed, you agree to hold harmless the technician and The Appliance Shark, LLC for any resulting damage.

Waiver: Working with Water

Plumbing-connected machinery carries risks of leaks/flooding and significant damage. Except for gross, clearly proven carelessness, you agree to hold harmless The Appliance Shark, LLC Service, its principals, agents, and employees from such occurrences.

Waiver: Failed Cooling

Complex components can fail without warning; diagnoses and repairs may not restore intended performance, potentially causing spoilage, inconvenience, or loss. You agree such risks are yours alone and hold The Appliance Shark, LLC harmless.

Waiver: Sealed System Repair

Sealed system work (often soldering/welding in confined spaces) introduces heat/flame risks. While care is taken, you accept these risks and hold The Appliance Shark, LLC and its technicians harmless for related harms.

Waiver: Lifting Glass Cooktop

Separation of adhesive-bonded glass/ceramic tops may fracture. You agree these risks are yours and hold The Appliance Shark, LLC harmless.

Waiver: Electrical Issues

Electrical components can fail due to lightning, surges, wiring issues, fluctuations, etc. Causes may be untraceable. You agree to hold The Appliance Shark, LLC harmless.

Warranty / Extended Warranty / Service Contract Liability Release

Customer pays for repair and seeks reimbursement from manufacturer/extended warranty/service contract if applicable. Liability for repair cost is not waived and remains the customer’s if any third-party fails to pay. If billed directly, customer agrees to remit charges immediately and any collection/attorney fees. You release The Appliance Shark, LLC and its owners, officers, agents, employees, technicians, insurers, reinsurers, and assigns from liability for damages arising from efforts to repair your appliances.
